Terms of Service

These Terms of Service ("Terms") are a binding legal agreement between you ("you", "Customer") and ALIENZHOUSE LTD, a private limited company registered in the Republic of Rwanda (TIN 155603688, registered office: Westerwelle Startup Haus, Gasabo, Kigali, Rwanda) ("Hamla", "we", "us", "our"). By accessing or using the Hamla platform at hamla.io or any of our services, you agree to these Terms in full. If you do not agree, you must stop using the Service.
1. The Service
Hamla is an AI-powered marketing automation platform that connects to the Customer's existing systems (store platforms, ad platforms, social platforms, messaging tools, CRMs, point of sale, booking systems, or any custom data source), reads the data the Customer authorizes, and executes marketing campaigns across channels including email, WhatsApp, SMS, push notifications, and on-site popups. Hamla is industry-agnostic, market-agnostic, and language-agnostic, suitable for any business with marketing needs.
We add features, channels, and improvements on an ongoing basis. Some features require a paid subscription or prepaid credits.
2. Eligibility and Accounts
To register an account on Hamla you must: (a) be at least 18 years old, or an authorized representative of a legal entity; (b) be capable of entering into a binding contract in your jurisdiction; (c) not be prohibited from using the Service under any applicable law.
You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account.
3. Subscriptions and Payment
3.1 Plans
We offer a Free plan and paid plans (Starter, Growth, Business) plus one-time Credit Packs. Pricing and monthly quotas are published at hamla.io/pricing and may be updated with at least 30 days' prior notice.
3.2 Payment Processor
All subscription and Credit Pack payments are processed through Polar.sh. By making a payment you also agree to Polar's terms. We do not store your credit card details on our servers.
3.3 Free Trial
We may offer a free trial (typically 7 days) on paid plans. At the end of the trial, your subscription automatically converts to a paid plan at the advertised rate unless you cancel before it ends.
3.4 Auto-Renewal
Subscriptions auto-renew at the start of each billing cycle until cancelled. You can cancel from your dashboard at any time; your Service continues until the end of the current cycle after cancellation.
3.5 Credits
Paid plans include a monthly AI credit allowance that resets each cycle and does not roll over. Credits purchased via Credit Packs do not expire and roll over indefinitely. When consuming, we deduct monthly allowance first, then pack credits.
3.6 Refunds
Subscriptions and Credit Packs are non-refundable except where required by law. We handle refund requests in good faith where there was a material technical failure on our side.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited messages (spam) or contact recipients who have not given you prior explicit marketing consent under applicable laws (such as CAN-SPAM, GDPR, and local anti-spam regulations).
- Transmit content that is illegal, deceptive, misleading, or infringes on the rights of others.
- Send content containing hate speech, harassment, pornography, or promoting violence or criminal activity.
- Use contact lists that were purchased, rented, or collected without consent.
- Attempt unauthorized access to our systems, other Customers' data, or bypass security controls.
- Reverse-engineer, scrape, or resell the Service without our prior written permission.
We reserve the right to review campaigns that raise abuse concerns and to immediately suspend accounts without prior notice in cases of material abuse.
5. Contact Consent Warranty
When you use Hamla to send messages to your customers, you warrant to us that you have full legal consent from each recipient to send the relevant message in accordance with the laws of their jurisdiction. You are solely responsible for obtaining, documenting, and maintaining such consents.
You agree to fully indemnify us for any claim, fine, or complaint arising from your failure to obtain required consents from recipients.
6. Third-Party Integrations
Hamla integrates with third-party platforms including Salla, Zid, TikTok, WhatsApp (Meta), Polar, Twilio, Resend, Anthropic, Google, and others. By using any integration, you also agree to the terms of that platform.
We act only as a connector. We are not responsible for third-party platform performance or for API changes that may temporarily disrupt an integration. When disruptions occur, we use commercially reasonable efforts to restore the integration promptly.
7. AI Features
Hamla provides AI-generated recommendations, copy, and content. These outputs are suggestions only. You are responsible for reviewing all AI-generated content before sending it to your customers. We do not warrant the accuracy, completeness, or suitability of AI outputs, and we are not liable for damages from content you did not review before sending.
8. Intellectual Property
Ownership of the Hamla platform, trademarks, branding, interfaces, and proprietary AI models remains fully with us. We grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription period.
Ownership of all content and data you upload, create, or have processed on your behalf through the Service (your business data, contact lists, campaign copy, etc.) remains yours. You grant us a limited license to process this data only to the extent necessary to operate the Service.
9. Confidentiality
We will protect the commercial data you share with us under the same confidentiality standards we apply to our own confidential information, and will not disclose it except with your permission or as required to comply with a legal order.
10. Disclaimer and Warranty Limitations
The Service is provided "AS IS" and "AS AVAILABLE." We make no express or implied warranty regarding: (a) uninterrupted or error-free availability; (b) specific marketing campaign outcomes; (c) message delivery rates on channels where we rely on third parties; (d) the accuracy of AI recommendations.
11. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability to you for all claims arising from the Service is capped at the fees you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. In no event are we liable for indirect, consequential, incidental damages, loss of profits, loss of data, or loss of business.
12. Indemnification
You agree to indemnify, defend, and hold us harmless from any claim, loss, or liability arising from: (a) content you send through the Service; (b) your use of the Service in violation of these Terms; (c) your violation of any applicable law or third-party terms.
13. Termination
You may terminate your subscription at any time from your dashboard. We may terminate or suspend your account if: (a) you materially breach these Terms; (b) you are more than 14 days in arrears on payment; (c) required by law. On termination, you may export your data within 30 days; thereafter we delete your data per our Retention Policy unless legally required to retain it.
14. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes at least 30 days before they take effect, by email or in the dashboard. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Republic of Rwanda without regard to conflict-of-law principles. We will first seek to resolve any dispute amicably within 60 days of written notice. Failing that, the courts of Kigali, Rwanda have exclusive jurisdiction, except where applicable law in your jurisdiction grants you a non-waivable right to bring a claim in a local court.
16. General Provisions
If any provision is held unenforceable, the remaining provisions remain in effect. No waiver of any right constitutes a waiver of other or future rights. You may not assign these Terms without our written consent. These Terms — together with the Privacy Policy and any Data Processing Addendum — constitute the entire agreement between us.
